Comments: As far back as 2006, the Parliamentary Assembly of Bosnia and Herzegovina adopted the Law on Changes and Amendments to the Law on the Human Rights Ombudsman of Bosnia and Herzegovina, which provides for the termination of the entity-level ombudsman offices and transfers responsibility to the institutions of BiH. Acting in compliance with this law, in 2007 the Parliament of the Federation of Bosnia and Herzegovina passed the Law On Manner of Terminating the Federation of Bosnia and Herzegovina Ombudsman Office in the Transitional Period and Transfer of its Responsibility to the Office of the Human Rights Ombudsman of Bosnia and Herzegovina. This law asserts how the Office of the Ombudsman of the Federation of Bosnia and Herzegovina will eventually cease to operate once the legal requirements regarding the transitional period are fulfilled. These legal requirements are necessary for merging the entity-level ombudsman offices with the Office of the Human Rights Ombudsman of Bosnia and Herzegovina. Comments: Given the fact that over the last two years the ombudsman offices in BiH have been operating in an unusual environment with regards to the political authorities (failure to merge entity-level ombudsman offices into the state-level ombudsman office on the one hand, and failure to appoint the state ombudsmen within the legally stipulated time frame on the other), it is obvious that the position of the ombudsmen as an institution in BiH is not clearly and finitely defined. This significantly undermines the credibility of the ombudsmen as protectors of human rights. When they assumed office in early 2009, the newly-appointed ombudsmen of BiH stated that the Ombudsman Office in Sarajevo contained a backlog of complaints that citizens filed over two years ago.
