Indicator and sub-Indicator Details

52 In law, is there a national ombudsman, public protector or equivalent agency (or collection of agencies) covering the entire public sector?

52: In law, is there a national ombudsman, public protector or equivalent agency (or collection of agencies) covering the entire public sector?

Score: YES  NO score
Comments: The above-mentioned decree establishes the "Commission nationale consultative de promotion et de protection des droits de lHomme" as the national ombuds-agency. The agency is little known and in practice not effective, but in law it does exist.

Peer Review Comments: I reserve my position that the "Commission Nationale Consultative de Promotion et de Protection des Droits de l'Homme" should not be considered an ombudsman.

Peer Review Comments: I have serious doubts if one can consider the "Commission Nationale Consultative de Promotion et de Preotection des Droits de l'Homme" as the national ombudsman. I really doubt if Algeria has an experienced body with the authority to inquire into and judge grievances of citizens against the executive branch of government.

53 Is the national ombudsman effective?

53a: In law, the ombudsman is protected from political interference.

Score: YES  NO score
Comments: The above-mentioned decree underlines the financial and administrative independence of the commission, but re-affirms nevertheless that it is placed "next to" the President of the republic, who appoints the head of the agency. Furthermore, representatives of several ministries are members of the commission.
